1. About these Terms
These Terms govern your use of the FLMPK mobile application, website and related services (the Service). The Service is supplied by FLMPK Ltd, a company incorporated in England and Wales under company number 17350510. Contact us at [email protected].
By creating an account, starting a trial, subscribing or using the Service, you agree to these Terms. Our Privacy Notice explains how we use personal data.
2. What FLMPK does
FLMPK helps you discover films, receive personalised recommendations, use Benton to express what kind of film fits the moment, organise film choices and find streaming availability.
FLMPK does not host, stream, sell or otherwise supply films for viewing. Viewing takes place through third-party services, subject to their terms, subscriptions, availability, age classifications, content warnings and parental controls.
Recommendations are discovery suggestions, not assessments that a title is suitable, safe or appropriate for every viewer. Film metadata, credits, artwork, ratings, classifications, warnings and streaming-availability information come from third-party sources and may be incomplete, delayed or inaccurate. Check the relevant streaming service before paying, renting, buying, subscribing or viewing.
3. Accounts and eligibility
You must meet the minimum age shown during onboarding and in the applicable app-store listing. If you have not reached the age of legal majority where you live, a parent or guardian must review and agree to these Terms for you. FLMPK is not directed to children under 13 and does not offer child profiles or parental controls.
You must provide accurate account information, keep your sign-in credentials and devices secure, and tell us promptly if you think someone has accessed your account without permission. You may not create an account for another person without lawful authority.
4. Seven-day trial
Eligible new subscribers may be offered a seven-day trial. Eligibility is determined through the Apple App Store or Google Play and may depend on previous use of an offer.
Before you confirm a purchase, the store screen will show the subscription price, currency, trial length, renewal terms and the store account that will be charged.
Unless you cancel before the renewal time shown by the store, the trial converts to a paid monthly subscription when it ends. Apple advises users who do not want a free or discounted trial to renew to cancel at least 24 hours before it ends. Google Play users should cancel before the next renewal time shown in their subscription settings.
Cancelling during the trial does not delete your FLMPK account.
5. Monthly subscription and renewal
FLMPK Monthly is an auto-renewing monthly subscription. The Apple App Store or Google Play purchase screen is the authoritative source for the price, currency, taxes and renewal date presented to you.
The subscription renews automatically until you cancel it through the store where you bought it. The store charges the payment method linked to your store account. FLMPK does not receive your full payment-card details.
Cancelling stops a future renewal. Access normally continues until the end of the paid period unless the store or applicable law provides otherwise. Deleting your FLMPK account does not cancel the store subscription, and cancelling the store subscription does not delete your FLMPK account.
You can restore an eligible purchase through the app where the store supports restoration.
6. How to cancel
Apple: use the subscription controls in your Apple Account or App Store settings.
Google Play: use the Subscriptions section of Google Play.
If you cannot locate the subscription, check which Apple or Google account made the purchase. FLMPK can help investigate entitlement or restoration problems, but it cannot cancel a store subscription on your behalf.
Cancellation rights provided by consumer law remain unaffected.
7. Refunds, withdrawal and billing complaints
For a charge made by Apple, use Apple’s refund-request process. For a charge made by Google Play, use Google Play’s refund process. Store procedures do not remove FLMPK’s responsibility for a defective Service or any mandatory consumer remedy for which FLMPK is legally responsible.
If the problem concerns FLMPK access, an entitlement not being recognised, a defective service, or a charge you cannot resolve with the store, contact [email protected]. Include the store, date and a non-sensitive order reference. Never send a password, full payment-card number or store credentials.
Nothing in these Terms limits any mandatory right to cancel or withdraw, or to obtain a refund, price reduction, repair, repeat performance or other remedy. Where the law where you live gives you a cooling-off or withdrawal right, that right remains available. If Brazilian consumer law applies, the statutory seven-day right to withdraw from a distance contract and obtain the applicable refund remains available. Store processes may be used to implement a right but do not replace mandatory rights against FLMPK.
8. Information you send to FLMPK
If you contact support or submit an account, privacy or legal request, FLMPK may use the information only as reasonably necessary to operate and secure the Service, handle the request, comply with law, and establish, exercise or defend legal claims.
Do not send passwords, full payment-card details, app-store credentials or information about another person unless it is reasonably necessary and lawful to do so.
9. Acceptable use
You must not:
- use the Service unlawfully or to harm another person;
- scrape, crawl, data-mine or systematically extract the catalogue, recommendations or other Service content;
- interfere with the Service, bypass controls or attempt unauthorised access;
- introduce malware or use automated activity that disrupts the Service;
- reverse engineer the Service except where the law expressly permits it;
- misuse support, reporting, account-deletion or privacy-request functions; or
- use FLMPK’s name, branding or output in a way that falsely suggests endorsement.
10. Intellectual property
The Service, software, FLMPK and Benton branding, interface, design and FLMPK-created material belong to FLMPK Ltd or its licensors. Film artwork, metadata, names, credits and availability information may belong to studios, distributors, data providers or other rights-holders. No ownership of third-party material passes to you.
You may use the Service for personal, non-commercial purposes in accordance with these Terms. No other licence is granted.
For an iOS download, these Terms are between you and FLMPK, not Apple. The licence is a limited, non-transferable licence to use FLMPK on Apple-branded products you own or control as permitted by Apple’s Usage Rules. FLMPK, not Apple, is responsible for the Service, support, warranties required by law, product claims and intellectual-property claims. You must comply with applicable third-party terms and confirm that you are not prohibited from receiving the Service under applicable trade restrictions. Apple and its subsidiaries are third-party beneficiaries of this paragraph and may enforce it.
11. Service availability and changes
We aim to provide the Service with reasonable care and skill, but it may be interrupted for maintenance, security, provider changes or events outside our reasonable control.
We may add, change or retire features where reasonably necessary. If a change materially reduces an ongoing paid service, or if FLMPK closes the paid Service, we will give the notice and provide the continued access, cancellation, refund or other remedy required by applicable law, including for any affected prepaid period.
12. Recommendation limitations
Personal taste and content suitability are subjective. FLMPK cannot promise that you will like a recommendation, that it is suitable for you, that a title will remain available, or that a third-party listing, rating or warning is complete or error-free. Benton and other recommendation tools support a viewing decision; they do not make decisions that produce legal or similarly significant effects.
No studio payment influences FLMPK recommendation rankings. FLMPK is ad-free and does not sell users’ viewing or taste data.
13. Suspension and termination
You may stop using FLMPK, cancel a store subscription and delete your account at any time; these are separate actions.
We may restrict or suspend access where reasonably necessary to protect users or the Service, investigate fraud or security issues, comply with law, or respond to a serious breach of these Terms. We will act proportionately and give notice and a reasonable opportunity to respond where reasonably possible.
We may close an account for a serious or repeated breach. Restriction, suspension or closure does not itself cancel an Apple or Google subscription. If FLMPK wrongly denies an ongoing paid service, mandatory consumer remedies remain available.
14. Consumer rights and liability
FLMPK will provide the Service with reasonable care and skill. Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.
Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be limited.
Subject to those protections, FLMPK is not responsible for losses that were not reasonably foreseeable when the contract began or for business losses arising from consumer use of the Service.
15. Complaints
Send complaints to [email protected] with the subject “FLMPK complaint”. Explain what happened, the outcome you want, the relevant account email and any non-sensitive store reference. We will acknowledge and investigate the complaint, keep you informed where the investigation continues and provide an outcome without undue delay. Where Brazilian e-commerce rules apply, we will acknowledge receipt immediately and provide the required substantive response, ordinarily within five days.
Billing and refund requests may also need to be handled through Apple or Google. Privacy complaints are explained in the Privacy Notice and Privacy Choices page. You retain the right to use any applicable regulator, alternative dispute resolution process or court remedy.
16. Changes to these Terms
We may update these Terms when the Service, its providers or the law changes. We will identify the current version and effective date and give appropriate notice of material changes. We will request agreement where required.
17. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you retain mandatory protections and rights to bring proceedings available under the laws of the country or state where you live.
